Terms and Conditions

Last updated: September 2, 2026

1. Scope and provider

These Terms and Conditions apply to all orders placed by consumers and businesses through the online shop at www.wearakoya.com.

The contracting party is:
Fabian Lindner
Sole trader, doing business as “akoya”
Weidenstieg 10
22926 Ahrensburg
Germany
Email: info@wearakoya.com

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (Section 13 of the German Civil Code, BGB). Terms and conditions deviating from these do not become part of the contract unless we expressly agree to them.

2. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to order.

By clicking the order button, you submit a binding order for the goods contained in your shopping cart. Receipt of your order is confirmed by email immediately after submission. This confirmation of receipt does not yet constitute acceptance of your order.

The purchase contract is concluded once we expressly declare acceptance of the order, ship the goods and confirm this by email, or – in the case of advance payment or payment service providers – initiate the payment process. If we do not accept the order, we will inform you without delay; any payments already made will be refunded promptly.

3. Storage of the contract text

We store the text of the contract and send you the order details as well as these Terms and Conditions by email. You can view and print the Terms and Conditions on this page at any time. Your past orders can be found in your customer account, if you have created one.

4. Language

German is the only language available for concluding the contract.

5. Prices and shipping costs

All prices are final prices in euros and include statutory VAT. Shipping costs may apply in addition to the prices stated. Shipping costs are clearly communicated to you on the product pages, in the shipping information, and at the latest during the order process before you place your order.

DestinationShipping costFree shipping from
Germany€6.19€49.99
EU (other countries)€9.99€69.99
United Kingdom€12.99€79.99
USA€16.99€89.99

For deliveries to the United Kingdom and the USA, import duties and customs fees may apply in addition; these are not included in our shipping costs and are to be borne by the buyer upon receipt of the goods.

6. Delivery

We deliver to Germany, the rest of the EU, the United Kingdom, and the USA. Within Germany, delivery generally takes 3 to 7 business days after conclusion of the contract, or from the day after the payment order is issued in case of advance payment. For the rest of the EU and the United Kingdom, delivery generally takes 5 to 10 business days; for the USA, 7 to 14 business days – depending on local customs clearance. Our textiles are finished to order; the production time is already included in these figures.

Deviating delivery times are stated on the respective product page. Should a delivery be unexpectedly delayed, we will inform you without delay by email.

If the ordered goods are unavailable because our supplier fails to deliver to us despite a contractual obligation to do so, through no fault of our own, we may withdraw from the contract. In this case we will inform you without delay and promptly refund any consideration already provided.

7. Payment

The payment methods shown during the order process are available to you. Payment is due upon conclusion of the contract unless otherwise agreed. Where payment is made via a payment service provider, that provider's terms apply in addition.

8. Retention of title

The goods remain our property until paid for in full.

9. Right of withdrawal

Consumers have a statutory right of withdrawal. Details, along with the sample withdrawal form, can be found in our withdrawal policy.

10. Liability for defects

Statutory liability for defects applies. If the delivered goods are defective, you may first demand subsequent performance – that is, remedy of the defect or delivery of goods free of defects. Under the statutory requirements, you may additionally withdraw from the contract, reduce the purchase price, or claim damages.

Please report obvious transport damage to us as promptly as possible. Late or omitted reports have no effect on your statutory rights – doing so simply helps us assert claims against the shipping provider.

11. Liability

We are liable without limitation for damages resulting from injury to life, body, or health, as well as for damages based on intent or gross negligence, and under the Product Liability Act.

In the case of slightly negligent breach of material contractual obligations – that is, obligations whose fulfilment is essential to the proper performance of the contract in the first place and on whose observance you may regularly rely – our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability is excluded.

12. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

13. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.

Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
